Statement submitted by Mr. Somnath Bharti, the then Law Minister, to Mr. B L Garg Committee in the Khirki Extn Sex and Drug Trafficking Matter:

Khirki Ka Sach

Prior to eventful night of 15th and 16th January 2014, local residents of Khirki Extension, Khirki Village, Hauzrani and Malviya Nagar had approached authorities in Police and the Government of India ranging from Ministry of Home to SHO Malviya Nagar on the issue of illegal sex and drug trafficking running in the area of Khirki Extension and Khirki Village. Copies of few of such applications are annexed as annexure A-1. But for reasons worth a judicial probe, which I am sure that this Hon’ble Judicial Commission will surely look into that no action was taken.

Deeply perturbed and disturbed the local residents approached me being the area MLA on the issue asking me to take immediate action. In the morning of 15th January, 2014 when they described the horrific consequences of not getting the complaint on the sex and drug issue addressed, I promised that I will surely take action to get this disease cured. In the night of 15th January after I arrived from the Secretariat somewhere between 11-12 AM, I was told that the horrific scene of foreign men and women indulging in sex and drugs activities was in action outside Sai Baba Mandir, Khirki Extension. Upon which I got into my car to proceed towards the site, enroute I met a PCR Van who was requested to accompany me. With the PCR Van I reached the site, the scene I saw was not only horrific but was shameful too. Big cars were parked, girls and boys majorly from African Countries, were all around active in aforementioned activities. On request Police officials of the PCR van caught hold of two of them, proof thereof is available in the annexed USB drive. We requested Police officials to request the local SHO to send more force and the women police. At no point of time anybody but Police touched the body of two red handed caught women as evidenced in the video available in the USB drive. The Police was so slow that only two out of a considerably large number of available & indulged men and women were caught. Reasons to slow and almost unwilling approach to apprehend these people require judicial probe, which I am sure this Hon’ble Judicial Commission will take note of. The local residence suffering from this disease for so long pointed towards a house opposite Sai Bab Mandir and informed Police present at the site that the house was full of such men and women and further requested to do whatever is possible within the existing legal means to catch them. Police did not budge at all to the request and stood with no motion whatsoever. I contacting various Police Officials including Commissioner and DCP Mr. Jaiswal but could not get through any of them. Couples of calls were made to Police No. 100 also. After a considerable gap SHO Mr. Vijay Pal with Mahila Police arrived, though the distance between the Police Station and the site of crime was of not more than 10 minutes for a motorised vehicle. In sometime a Maruti Van bearing No. DL3C BV 2984 arrived at the site which was a private car and carrying four African women. The driver of the car, on record, admitted that he was coming from Dwarka and picked up these women from a bus stop. A fact which is so far been withheld by the Police as well as by the Media for the reasons worth judicial probe which I am sure is also being looked into by this Hon’ble judicial commission. SHO Malviya Nagar violated the sanctity of the car by inserting his own men in the car and refused to do any search of the car. ACP Mr. Jhakhar and SHO Mr. Vijay Pal kept on insisting that they will search neither the car nor the pointed to house and they also refused on record, to connect me to DCP Mr. Jaiswal. It is most pertinent to bring to notice to this Hon’ble judicial Commission that DCP Mr. Jaiswal on 12th January, 2014 had visited the site and had directed the ACP and concerned SHO to do everything within their power to stop the drug and sex trafficking in the area but no action was ever taken on his direction, as per the information available with me. My continuous requests to ACP Mr. Jhakhar and SHO Shri Vijay Pal that something (lawful) be done on priority viz-a-viz search of the pointed to house and the car fell down on deaf ears. My as well as local residents’ request that the landlord of the pointed to house be summoned to unearth the truth as to the allegation of the local residents went unattended for reasons worth the time of this Hon’ble judicial commission. At one point of time SHO Shri Vijay Pal, as evidenced in one of the videos on the USB drives was taking the car to the Police Station unopposed by me but at the instance of ACP Shri Jhakhar he gave up the idea on my repeated requests that at least the house be surrounded if search warrant was coming in the way also went unheeded. All this delay caused by ACP Shri Jhakhar in collusion of Shri Vijay Pal was aimed at giving enough time to the sex and drug racketeers living in the pointed to house have easy way out to flee away from the reach of police and destroy the banned substance-drugs. When insisted by me for action, SHO Shri Vijay Pal left me and other local residents at the mercy of the people living in that pointed to houses who were dangerous as per the local residents. Soon ACP Shri Harpal Singh arrived who asked me to give a written complaint to him to carry search of the house, which was given but no search was carried. In one of the videos on the USB drive, the girls sitting in the car can be easily seen destroying the drugs in their possession. In addition, policemen in violation of the lawfully warranted sanctity of the car entered and exited the car many a times and thus ensured that dangerous drugs in possession of the four girls sitting in the car disappear. On enquiry as to what legal procedure/methodologies we have, to assess drug charges on the girls, Police was of the opinion that the prevalent procedures and processes are too time consuming and some of the locals suggested that they be taken to AIIMS for blood samples. Seeing nothing coming out otherwise and to diffuse growing resentment among the locals over complete in-action of the police, the car along with the girls and Police men sitting in the car was taken to AIIMS. They did not wait for me to accompany the car and I left much after. Enroute near Police Booth in Malviya Nagar Market two cars at least one of them was white in colour blocked my way and people resembling African nationals were seen coming out of the car and running towards our car. I somehow managed to escape through some other route and reached AIIMS. When I complained of this threat to my life to SHO Malviya Nagar he gave no heed to the same. On my reaching, I noticed that girls were already taken by the Police, who their on had asked for urine and blood tests while the suggestions of the locals duly agreed upon by the police was only for blood test. MLC was prepared of all the four girls at the behest of the Police and refusal of the girls from giving any blood test or showing their passports to the Doctor when demanded duly find a mention in MLC. SHO Malviya Nagar refused to listen to my request to carry search of the already compromised car and to get forensic to pickup the traces of drugs spread out in the car. He rather advised that I should request the Doctors of AIIMS to pick up the different traces of the drugs from the car but the Doctors said that they do not have the requisite equipment/expertise to heed to my request. After some time SHO Malviya Nagar on his own decided to search the car and the search led to the recovery of considerable numbers of condoms and traces of drugs were seen all around. But SHO Malviya Nagar refused to call the forensic and rather said that he will take the complete car to forensic. Seeing the adamant behaviour of the Police while the girls were still in the hospital, I left the hospital premises sometime around 7.00 AM.

There were media people present all the time at the site of the crime but not at the hospital probably at the behest of the Police. Some of the media Channels picket up the story not to show the issues of sex and drugs trafficking and deliberately opted to run a campaign against me possibly at the behest of vested interest of the people as sex and drug racketeers are very powerful having deep nexus with the Politicians and Police. When the media house started showing me as racist and casting aspersions on my dignity and showing people from Africa residing in the area scared, being the area MLA I decided to form a committee of local Indian Residents from Africa as well as Indian Communities living in the area to harmonise their relationship with each other and also to bridge the cultural gap. In one of such meetings organised by them on 31st January, 2014 I was invited to speak and address the distrust among African and Indian People. The meeting was attended in large number from both the communities including women. In my appeal to African people that they should feel fearless in reporting the wrongs done on them by anyone including police, the African Nationals specially women expressed their joy. Both the communities exchanged their numbers. Within no time some of the girls of Uganda starting SMSing to locals that they are in danger and being denied food on refusal to sleep with men brought by some lady to them. When this continued for couple of more days then local residents organised their safe reach to Dy. Commissioner. Now FIR by them against queen pin stands lodged and I have been told that master mind behind this inhumane exploitation of the Uganda girls in the name of the jobs has been arrested. It is most important for me to bring to your notice that these three girls have identified the same house which the police was unsuccessfully asked to search on 15thJanuary night as the house where girls from Uganda are forced to live the most inhumane life and sleep with men against their wishes. This house alongwith many other similarly placed houses duly find mention in the complaints lodged by the locals to the Police, already annexed as Annexure A1. To suppress the matter, SHO Malviya Nagar orchestrated a sinister plan of pressurising and defaming me. He used some Uganda girls to file a complaint against locals for that incident and further drafted an application under section 156(3) Cr.P.C. on their behest to get an order against himself for filing FIR. Surprising speed was witnessed as drafting/filing/listing as well as order on this application happened on the same day. There are advocates who have witnessed and informed me in writing, copy annexed, that SHO himself dictated application under section 156(3) Cr.P.C. in Saket Court typing pool. This Hon’ble Judicial Commission is also requested that media houses including NDTV and Times Now be summoned to be questioned on the sources of the allegations of racism and inhumane insults viz. making the women urinate in public, beating them etc.

After this incident and after the three Uganda girls having deposed, the affected areas of Khirki Extension, Khirki Village and Hauzrani have become liveable, but still the Police have not arrested local Property Dealers like Chaudhary Properties and many others involved in flesh-trade alongwith Uganda queen pins. I have told that the Beat Constable has also not been removed and no action against any Police officials been commenced. This Hon’ble Commission is also requested to order procurement of the full unedited interview given by three Uganda Girls to CNN IBN to know the horrific details of the flesh-trade and drug trade against which my visit on 15th January night on the request of the locals. This is for your kind submission. I also humbly request that I may be allowed to submit additional information and does as and when I recall or come to my notice.
Since there has a massive campaign by the media to hide the above narrated actual details on the issues and thus sidestepping the core issues, please pass it on after reading to your friends and if possible, print and distribute to educate the people.
